{"id":293,"date":"2022-05-09T23:58:19","date_gmt":"2022-05-10T05:58:19","guid":{"rendered":"https:\/\/seabirdcanadainc.ca\/blog\/?p=293"},"modified":"2022-05-19T20:02:16","modified_gmt":"2022-05-20T02:02:16","slug":"ircc-will-refuse-to-process-the-caregiver-work-permit-under-temporary-foreign-worker-program","status":"publish","type":"post","link":"https:\/\/seabirdcanadainc.ca\/blog\/ircc-will-refuse-to-process-the-caregiver-work-permit-under-temporary-foreign-worker-program\/","title":{"rendered":"IRCC will refuse to process the caregiver work permit under Temporary Foreign Worker Program."},"content":{"rendered":"\n<p class=\"has-text-align-justify wp-block-paragraph\">Ministerial Instructions revised on April&nbsp;22, 2022, instruct officers to&nbsp;<strong>refuse to process<\/strong>&nbsp;work permit applications with LMIA supported job offers for caregiver occupations (National Occupational Classification&nbsp;4411 and 4412 \u2013 home childcare workers and home support workers) in specific circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Refusal to process of work permit (NOC&nbsp;4411 and 4412) scenarios<\/strong>:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Scenario 1: &nbsp;If the application is made at the port of entry.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">On or after April&nbsp;22 2022, The officer will refuse to process the application of an LMIA-based work permit of all foreign nationals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Scenario 2: If the application is made outside of Canada.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\">The officer will refuse to process the application of work permit of all foreign nationals if the job location is destined outside Quebec and the LMIA application for a caregiver was received on or after June&nbsp;18, 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Exemption:<\/strong> The officer will process the application, if applicant is currently authorized to work and:<\/p>\n\n\n\n<ul class=\"wp-block-list\" type=\"a\"><li>work permit holder<\/li><li>is not a business visitor<\/li><li>study permit holder<\/li><li>destined to work in Quebec<\/li><li>work permit application for which the LMIA application was received before June&nbsp;18, 2019<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Scenario 3: If the application is made inside Canada.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officer will refuse to process the work permit application of foreign nationals who are not authorization to work in Canada. For instance: Visitors in Canada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Exemption:<\/strong> The officer will process the application if applicant is currently authorized to work and:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>work permit holder<\/li><li>is not a business visitor<\/li><li>study permit holder<\/li><li>destined to work in Quebec<\/li><li>work permit application for which the LMIA application was received before June&nbsp;18, 2019<\/li><\/ul>\n\n\n\n<p class=\"has-text-align-justify wp-block-paragraph\"><strong>Note: <\/strong>Ministerial Instructions exclude applicants who intend to work as foster parents under NOC\u00a04411 or do exclusively housekeeping duties under NOC\u00a04412.
